1. General Agreement
By accessing or using MyFavi Autos (“MyFavi,” “we,” “us,” or “our”), you (“you,” “your,” “User”) agree to these Terms & Conditions (“Terms”), including any related policies (Privacy Policy, Cookie Policy). Continued use implies acceptance of updated Terms.
2. Our Services
MyFavi provides a peer-to-peer online platform where verified individuals can buy, sell, or trade used vehicles locally. We do not sell vehicles, facilitate payments, or guarantee listings—we connect buyers and sellers.
3. User Eligibility & Verification
To ensure a trusted marketplace, all users must complete an identity verification process before listing a vehicle or contacting sellers. This may be conducted by a trusted third-party vendor, and you agree to provide accurate and complete information as required. You must be at least 18 years old to use our services.
4. User Responsibilities and Conduct
4.1 Private Sellers Only
- You must be a private seller—not a dealer or commercial entity.
- You can post up to 5 active listings per year for free. Additional posts require a 1% fee based on the vehicle's sale price, payable at the time of listing through our designated third-party payment processor.
- Posting more than 5 vehicles in 12 months may require reverification or transition to a business account.
4.2 Accurate Listings & Prohibited Content
- You are solely responsible for all listing information, including photos, specifications, and descriptions.
- Misleading, false, or illegal content is strictly prohibited. This includes, but is not limited to, listings with tampered VINs, undisclosed salvage or rebuilt titles, vehicles with active liens, stolen vehicles, or any content that infringes on third-party intellectual property rights.
4.3 Community Conduct
- Do not post prohibited or harmful content (defamation, hate speech, personal data).
- No spamming, scraping, impersonation, or disrupting site functionality.
- Messages and content may be monitored or removed to enforce these Terms and ensure community safety.
5. Transactions & Liability
MyFavi is a neutral platform and is not a party to any sale. Buyers and sellers are fully responsible for their own decisions, transactions, and associated costs (tax, title, delivery, insurance).
We do not verify the authenticity of vehicles or facilitate payment; please use safe practices such as Vehicle History Reports (VHRs), secure payment methods, and proper legal documentation.
All negotiations, inspections, and legal compliance are strictly between the buyer and seller.
6. Intellectual Property & Content License
All site content (design, logos, software, images) owned by MyFavi or licensed to us remains protected and may not be reused without permission.
By posting content (listings, messages), you grant MyFavi a perpetual, royalty-free, worldwide license to use, adapt, and display that content for service operation and promotional purposes.
7. Third-Party Integrations
MyFavi may integrate links or services (VHR providers, inspection services, insurance partners). These are independent services, and MyFavi is not responsible for their terms, quality, or performance. Your use of such third-party services is at your own risk.
8. Termination
We may suspend or terminate your access for violations of these Terms, including suspected fraud, spam, or illegal activity—without notice or liability on our part.
9. Disclaimers & Limitations of Liability
No Warranty: MyFavi is provided “as-is.” We do not guarantee uptime, accuracy, security, or the suitability of any listing.
Limited Liability: To the fullest extent permitted by law, our maximum liability to you is the amount you have paid us for services. We are not liable for any indirect, incidental, or consequential damages (e.g., loss of data, opportunities, or profits).
Legal exclusions that are inapplicable under certain jurisdictions do not invalidate the remaining provisions.
10. Indemnification
You agree to defend and indemnify MyFavi and its affiliates from any claims, damages, or expenses (including reasonable attorney fees) arising from your content, conduct, or violation of these Terms.
11. Dispute Resolution
11.1 Disputes Between Users
MyFavi is not responsible for resolving disputes between buyers and sellers. We encourage users to communicate respectfully and resolve disagreements amicably. MyFavi will not arbitrate, mediate, or become involved in such disputes.
11.2 Disputes with MyFavi
Arbitration: Any disputes between you and MyFavi will be resolved via binding arbitration administered by a recognized arbitration body (e.g., JAMS) or in small claims court. By agreeing to these terms, you waive the right to a trial by jury and to participate in a class action lawsuit.
Location: Arbitration hearings will be held in your local area unless otherwise agreed.
12. Reporting Violations
Users can report listings, messages, or conduct that violates our Terms by using the reporting features within the app or by contacting our support team at Drive@MyFavi.com. We take all reports seriously and will investigate them accordingly.
13. Governing Law
These Terms are governed by the laws of the user's U.S. resident state or, if operating outside the U.S., the laws of the State of Delaware, without regard to conflict-of-law rules.
